CONDITIONS OF ELIGIBILITY

This grant is meant for people who create or take over an individual or collective company. Those who may benefit from it are:
- jobseekers on benefits or likely to go on benefits and who receive the unemployment insurance benefits, the specific conversion allowance or the AI (Insertion Allowance).
- jobseekers not receiving benefits that were registered with the ANPE during 6 of the past 18 past months
- Beneficiaries of RSA (Earned Income Supplement) - in Paris, the RSA has been substituted by the RMI (social welfare) and the API (single parent allowance) since June 1, 2009
- Beneficiaries of API (single parent allowance),

- youth aged 18 to under 26
– new services” as well as those hired in the frame of this scheme and whose contract was terminated before the term of the grant,
- people aged under 30 who are not on ASSEDIC benefits or recognized as handicapped workers,
- wage-earners who have taken over their ailing business, as part of a recovery or winding-up procedure,
- beneficiaries of business project support contract (CAPE)
- Individuals creating a company implanted within a “ZUS” – difficult urban area
- Beneficiaries of free choice of activity supplement mentioned in article L.531-4 of social security code (this supplement is one of the PAJE sections “early childhood benefit” and all the eligibility conditions, amounts, steps to take … may be consulted on the website.

PROCEDURE

All sectors

MODALITES

Regardless the activity sector chosen, the beneficiaries must create or buy-out a company, as an individual (craftsmen, traders, free lance workers) or as a company. All associations, EIG, or employee groupings are excluded.
In order to benefit from the ACCRE, the creator or buyer must take the reins, meaning:
- own over 50% of the capital (alone or with family, and at least 35% from personal contribution),
- be company manager and own at least 1/3 of the capital (alone or with family and at least 25% from personal contribution) provided that another associate does not own, directly or indirectly, more than half the capital.

The condition relating to taking the reins must be filled for at least 2 years counting from the creation or buying of the company. Several people may obtain assistance for a sole and same project, under the condition that:
- together, they own over 50% of capital,
- one (or several) of them have leadership qualities,
- each applicant holds a part of the capital at least equal to 1/10th of the part held by the main shareholder or unit holder. These conditions may be accumulated.

LEVEL OF INTERVENTION OF AID

The terms and conditions of the exemption vary according the categories of beneficiaries of the ACCRE. The exemption of charges (except for the complementary pension) is total for jobseekers compensated by the ASSEDIC or likely to be. For other beneficiaries, it covers only the part of incomes or remunerations that do not exceed 120% of the SMIC (Minimum. Interprofessional Growth Wage. Among contributions covered (employer and wage-earner contributions) are :
- health, maternity, invalidity, death insurance,
- (basic) old-age,
- Family allowances.

These exemptions are applied to:
- all contributions paid by the employer and employees and pertaining to the fraction of wages paid out during the exemption period, if this is a salaried worker scheme, this must then be requested by the employer,
- all contributions for an activity having benefited from exemption period, if this is a non-salaried worker scheme, this must then be requested by the non-salaried worker.

This exemption:
- is limited to a cap corresponding to 120% of the SMIC (minimum wage),
- is granted for one year. This time period may be extended under certain conditions if the company is under the micro-company fiscal scheme – BIC (business profits) – or a specific micro company declaration scheme – BNC (non-commercial profit). On this question, it is recommended to get information from the URSSAF.

Contributions relating to CSG-CRDS, to complementary pension (Arrco and Agirc), to Fnal and transport payments are not exempted.

OBLIGATIONS OF THE COMPANY

The grant application must be filed with the DDTEFP imperatively BEFORE the business creation or takeover.
